1. Who We Are

FlightClaim ("we," "us," "our") is a claims assistance service that helps airline passengers identify potential refund eligibility and submit refund requests to airlines and regulatory bodies. FlightClaim is not a law firm and does not provide legal advice or legal representation. Use of this service does not create an attorney-client relationship.

When you use FlightClaim, we may:

3. Eligibility and No Guarantee of Recovery

Our eligibility checker provides an assessment based on the information you provide and applicable DOT regulations. This assessment is informational only and does not guarantee that a refund will be approved or recovered.

Refund eligibility depends on many factors including, but not limited to: whether the flight was cancelled or significantly changed, whether you accepted rebooking or alternative compensation, the specific airline's policies, and the facts of your individual situation. FlightClaim makes no guarantee of any particular outcome.

4. Our Fee

Our service is contingency-based: you pay nothing unless we successfully recover a refund for you. If we recover a refund, our fee is 20% of the total amount recovered. This fee will be clearly disclosed before you authorize a claim submission.

By authorizing a claim submission through FlightClaim, you authorize us to collect our fee from the recovered amount or to charge the payment method on file when a refund is confirmed.

If a claim is unsuccessful, no fee is owed to FlightClaim.

By submitting a claim through FlightClaim, you grant us a limited authorization to communicate with the relevant airline and, if necessary, file a complaint with the DOT on your behalf, solely for the purpose of recovering the refund described in your claim. This authorization is limited to the specific claim and does not constitute a general power of attorney.

7. Communications

By providing your email address or phone number, you consent to receive communications from FlightClaim related to your claim, including status updates, requests for information, and notifications of outcomes. Standard messaging rates may apply for SMS. You may opt out of non-essential communications at any time by replying STOP to any SMS or clicking unsubscribe in any email.

8. Third-Party Services

FlightClaim uses third-party services to operate, including Anthropic (AI analysis), Stripe (payment processing), Twilio (communications), Supabase (data storage), and SendGrid (email delivery). Your use of FlightClaim is subject to the privacy practices of these providers as described in our Privacy Policy.

9. Limitation of Liability

FlightClaim's liability to you for any claim arising out of or related to these Terms or our services is limited to the fees you have paid to FlightClaim in the twelve months preceding the claim. FlightClaim is not liable for indirect, incidental, consequential, or punitive damages. Some jurisdictions do not allow these limitations; in those cases, our liability is limited to the fullest extent permitted by law.

10. Disclaimer of Warranties

FlightClaim is provided "as is" without warranties of any kind. We do not warrant that the service will be uninterrupted, error-free, or that any particular claim will be successful. Eligibility assessments are based on available information and are not legal opinions.

11. Governing Law

These Terms are governed by the laws of the State of New York, without regard to conflict of law principles. Any disputes arising under these Terms shall be resolved in the state or federal courts located in New York County, New York, and you consent to the personal jurisdiction of those courts.

12. Changes to These Terms

We may update these Terms from time to time. Material changes will be communicated to users with active claims. Continued use of FlightClaim after changes constitutes acceptance of the updated Terms.
